Privacy Notice
GD-code Labs & Studios (“GD-code”, “we”) provides this Privacy Notice explaining how we collect, use and safeguard the personal information you provide as a Client, Supplier, Collaborator or User (the “Users”), committing to protect its confidentiality and privacy at all times.
Pursuant to Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations, GD-code, informs all Users of its personal-data (“Personal Data”) processing policy, so that each User may freely and informedly decide whether to provide such information in connection with the software, hardware and technology services offered by GD-code.
“Personal Data” means any information that identifies or allows contacting an individual. GD-code, as data controller, will safeguard the data it receives to preserve both its confidentiality and integrity.
Under article 8 of the Law, and given that this Notice is available before Users share their data, Users are deemed to grant their tacit consent to the processing unless they directly object to GD-code.
Information we collect
GD-code does not obtain Users' personal data except where Users expressly and voluntarily provide it (for example, through this site's contact form). By doing so, the User declares the information is truthful. All data provided is treated confidentially and in accordance with applicable data-protection regulations.
Such information may include, without limitation:
- Full name
- Email address
- Phone number
- Company or organization
- Address
- Tax ID (RFC) and billing details
- City and state of residence
GD-code may contact Users electronically or by phone if additional information is required to complete an operation. Where banking or billing details are indispensable, they are requested solely to fulfil the obligations arising from the relationship between GD-code and the data owner.
Personal Data is accessible only to GD-code personnel and used for internal purposes, and is not shared with third parties except:
- When disclosure is necessary to identify, locate or take legal action against parties affecting the rights or property of GD-code or third parties.
- To comply with this Privacy Notice.
- To comply with requirements from competent authorities.
- When indispensable for the correct delivery of contracted services (e.g. cloud, email or payment-gateway providers), who process data only under our instructions.
Purpose of processing
The Personal Data collected is primarily used to allow GD-code to better understand its Users and provide individualized service according to the specific needs arising from the projects between Users and GD-code.
It may also be used for internal purposes such as auditing, statistics, performance evaluation and service-quality improvement, as well as identification, validation, contact, promotional activities and procedures related to the delivery of our software, hardware and technology services.
Security and principles
GD-code processes Personal Data in accordance with the principles of legality, consent, information, quality, purpose, loyalty, proportionality and accountability set out in the Law.
We adopt administrative, technical and physical measures to protect the personal information entrusted to us, aimed at preventing any loss, alteration, unauthorized access, disclosure, misuse or destruction, and we implement internal access controls.
ARCO rights
You may exercise your ARCO rights: access, rectification, cancellation and objection to the processing of your data, and revoke previously granted consent. To do so, submit a written request to privacidad@gdcode.com.mx.
The request must include your full name, a means to receive the response, a copy of official ID, your relationship with GD-code, and a clear description of the data over which you wish to exercise a right.
GD-code will respond within up to 20 business days from receipt, at no additional cost. Under article 32 of the Law, this term may be extended once for an equal period, which will be notified to you.

Changes to this Notice
GD-code may modify or update this Privacy Notice at any time to address legislative changes, internal policies or new service requirements. Any change will be available on this page.
This Notice is governed by the laws of the United Mexican States. Any dispute regarding its interpretation or compliance will be resolved by the competent courts of Mexico City.
